RAKwireless Affiliate Program Terms & Conditions

This Terms of Service is an agreement that governs your usage of the RAKwireless Affiliate program (“Program”), which is owned, operated, or provided by or on behalf of RAKwireless Technology Limited (“RAKwireless”). For purposes of this Terms of Service, the term "Affiliate" shall mean any individual that has signed up for the Program through the KickBooster platform to provide referral service to RAKwireless.

As a RAKwireless Affiliate, you agree to abide by this Terms of Service and any other additional RAKwireless Terms of Service regarding the Affiliate Program that may be provided and amended by us from time to time. Your access to and use of the Program is subject to legally binding terms and conditions, please carefully read all of the following before you proceed. We also recommend you to read the KickBooster terms and conditions at Kickbooster Terms of Use. Using the Program indicates your acceptance to this Terms and Conditions and that you intend to be legally bound by them. If you do not agree with this Terms of Service, please do not continue to use the Program.

The Program is the provision of a referral service that allows you to be an Affiliate by referring our products to other persons. In order to participate in the Program, you are required to sign up for a KickBooster account through RAKwireless. Upon which you will be requested to connect with your PayPal account. Every time you want to participate in this Program via sharing our products, you can create a unique link on the KickBooster dashboard using your KickBooster account. You can then share the unique link to other persons. To be considered a successful sale, the product must be purchased on RAKwireless Store (‘Store’). All sales outside the Store, including the RAK HotSpot Miner via the CalChip website, are excluded from the Program.

You may share your unique link on any social media platform or wherever you wish.

For you to earn a commission, you must generate a sale within the given 180-day cookie period from the date you received our unique link, any sale done outside the assigned duration will not be counted as commission. You can create a new link anytime in your KickBooster dashboard.

If any of your referred sales are canceled or returned, it will not be considered for a commission.

Before commission is paid, RAKwireless has a 30-day review period to verify qualified sales which will earn a commission.

For every successful referred sale, you will receive a 5% commission of the total sale (exclusive of shipping charges, duties and/or taxes). The commission will be paid by KickBooster via PayPal on the 1st and the 15th day of every month (or the following business day) after the review period. For example, if the sale is made on the 1st of the month (and has been deemed successful), the commission will be paid 30 to 45 days after. Note: Affiliates must meet a minimum commission of $20 to be eligible for payout.

Please refrain from using your own affiliate links when making personal purchases. All sales are put under review and RAK has the right to decline commission from these sales. If and when provided with a discount code for affiliate link, please refrain from using it for personal purchases. If an affiliate uses a discount code and affiliate link for its own purchases, RAK reserves the right to cancel the discount code without any notice to the affiliates.

It is a requirement that you own a PayPal account. Please note that it shall be your personal account, not the ownership, and not the account of any third party. This PayPal account is what KickBooster will use to pay you being our Affiliate. We are not responsible for any error or omission in the name, mailing address, or destination account information you provide.

PPC bidding is NOT allowed. If we were to suspect any PPC bidding by you, we reserve the right to suspend your account indefinitely.

RAKwireless will not be held liable for any indirect or accidental damages that will occur during the usage of the Program. We do not claim that the entirety of the Affiliate Program will be free of error although we will do our best efforts to main that the Program will run as smoothly as possible. You will be responsible for all activity on your account as well as for keeping all your passwords confidential.

The terms in this Terms of Service will take effect upon your acceptance to the Program and will end when the Program is terminated, or when you decide to delete your KickBooster account.

RAKwireless will send timely email updates to you being Affiliate partner regarding the Program.

To be a Program Affiliate, you must be at least 18 years old to be eligible and you will be responsible for all taxes and any other local requirements and fees.

Affiliate cannot be an employee or legal representative of RAKwireless. If we suspect that any RAKwireless employee or legal representative is utilising the Program, we reserve the right to suspend the KickBooster account.

Any form of paid advertising, spamming, and other unscrupulous practices will not be tolerated and may result in the withholding of the commission if RAKwireless deems that the Affiliate is acting in bad faith or otherwise acting contrary to the intent of the Program. Please do not use the Program directly or indirectly for any fraudulent or illegal undertaking, do not spam send your unique link for the purpose of distributing malware, virus, trojan, or any other malicious code or data or illegal or obscene material. Do not try to get unauthorized access to any account, password or other information of other users nor try to impersonate other users. Your use of the Program should comply with all applicable laws and regulations in the territory you reside.

The Affiliate shall hold RAKwireless harmless for all liabilities, damages, fines, judgments, claims, costs, losses, and expenses arising out of these Terms of Service due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of the Affiliate.

RAKwireless has the right to close any RAKwireless Affiliate’s account and deactivate their unique link when there is an attempt to use the Affiliate Program in a questionable manner, or if the action breaches this Terms of Service.

RAKwireless has the right to cancel the Affiliate Program or change its current Terms of Service and commission rate at any time in its sole discretion without notice. By updating this Terms of Service, the changes will be effective as of the date when the update is posted on this page. We may provide notice to you of the material revisions by means of a general notice on our websites at RAKwireless Affiliate Program Terms, please do revisit this page periodically to review these Terms of Service. Continuing the usage of our Program after the revisions are posted means you agree to our revised terms.

Nothing herein contained shall be deemed or construed to create a co-partnership or joint venture between the parties hereto and you shall not be deemed as agent for RAKwireless.

We encourage you to contact us using the following web form, if you are experiencing an issue, before resorting to the courts. If any legal action were to arise, these Terms of Service will be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region of the People’s Republic of China without giving rise to any principles of conflicts of law.
